I, THE PARTICIPANT, PARENT(S), LEGAL GUARDIAN, GUARDIAN, OR RESPONSIBLE PARTY OF THE PARTICIPANT:

IN CONSIDERATION of being permitted to participate in any way in the laser tag, birthday party, video games, group activity, and/or activities (hereinafter each an “Activity” and collectively the “Activities”) I, for myself,  for my personal representatives, assigns, heirs, and next of kin, and the Participant:

I ACKNOWLEDGE, agree, and represent that I understand the nature of the Activity or Activities. I am qualified, in good health, and in proper physical condition to participate in the Activity or Activities. I further agree and warrant that if at any time I start to feel sick or believe conditions to be unsafe, I will immediately discontinue further participation in the Activity or Activities. I understand that participation in Ultrazone Alhambra’s (hereinafter "Ultrazone") Activities involves physical activity that could injure me. I assume responsibility for any injuries or damages which may occur to me in, on or about Ultrazone’s premises from any cause, including, without limitation, the fault of Ultrazone, its owners, employees and agents, from all claims, damages or other liabilities present or future, whether known or anticipated that may result from or arise out of my involvement or participation in the use or intended use of the game or premises, facilities and equipment related thereto.

I FULLY UNDERSTAND THAT: (a) THE ACTIVITY or ACTIVITIES INVOLVE(S) RISKS AND DANGERS (including by way of example and not limitation, falling or loss of balance; striking padded or unpadded surfaces; being injured by equipment; being injured by the actions or inactions of other participants and bystanders; collisions with other participants; falls due to slick or uneven surfaces; equipment failures of any kind; equipment misuse by myself or others; exposure to communicable disease including, but not limited to, coronavirus/COVID-19, other viruses, bacteria, and all other infectious pathogens and disease vectors; physical injury or illness as a result of physical activity or being on the premises where the Activities take place) which could cause or result in serious bodily injury, including permanent disability, paralysis, and death (collectively, “RISKS”); (b) these RISKS and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the Activity or Activities, the condition(s) in which the Activity or Activities take(s) place, or THE NEGLIGENCE OF THE “RELEASEES” NAMED BELOW; (c) there may be OTHER RISKS AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my participation, or that of the minor, in the Activity or Activities.

I HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE MAIN STREET FAMILY ENTERTAINMENT, INC. Dba ULTRAZONE, located in Alhambra, California, its owners, administrators, directors, agents, officers, members, volunteers, and employees, other participants, sponsors, advertisers, and, if applicable, owner and lessors of premises on which the Activity or Activities take(s) place, (each considered one of the "RELEASEES" herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF ONE OR MORE OF THE RELEASEES OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT I, or anyone on my behalf, makes a claim against any of the Releases, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which any may incur as the result of any such claim.

I agree to engage in Ultrazone Activities according to the rules and instructions given to me by any members of the Ultrazone staff. I acknowledge that Ultrazone accepts no responsibility for any act or thing done by me which is not in accordance with the rules and instructions.

I accept full responsibility for any damage to Ultrazone premises, facilities, and/or equipment caused by me.

I agree to inform a member of the Ultrazone staff of any medical condition or treatment that I have before participating in Ultrazone laser tag.

I agree to allow Ultrazone to employ any audio, video, or photographs taken of me, my party and/or group while on the premises.

I have read this agreement, fully understand its terms, understand that I have given up substantial rights by signing it, and have signed it freely and without inducement or assurance of any nature. I intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid, the balance, notwithstanding, shall continue in full force and effect.

If you are a minor under the age of 18, your parent, legal guardian, guardian, and/or responsible party must sign and date below permitting you to participate in the above activities.

HAVING REGISTERED AS AN ULTRAZONE PLAYER, I ACKNOWLEDGE THAT THE LASER TAG SPORT IS A PHYSICAL ACTIVITY WHICH I JUDGE MYSELF FIT AND SUITABLY DRESSED TO PLAY.  I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND THIS WAIVER AND ACKNOWLEDGE THAT IF I AM UNDER 18 YEARS OF AGE, I HAVE DISCUSSED THE TERMS AND CONDITIONS OF THIS WAIVER WITH MY PARENT(S), LEGAL GUARDIAN OR RESPONSIBLE PARTY AND THEY HAVE CONSENTED TO THIS WAIVER.
