Sky Barre Liability Waiver

*Have not shown symptoms of COVID-19 in the past 14 days OR have been in contact with anyone who has tested positive in the past 14 days. According to the Center for the Disease Control, below are symptoms: ● Cough ● Shortness of breath or difficulty breathing ● Fever ● Chills ● Repeated shaking with chills ● Muscle pain ● Headache ● Sore throat ● New loss of taste or smell

*I agree to inform The Sky Barre immediately if I have developed symptoms within a two week period of being in the studio, or if I have learned that I have been in direct contact with someone who has later tested positive for the coronavirus within the same two week period .

*I understand this Hold Harmless Agreement is a release of legal liability. The risks that I am agreeing to assume include the risk that an injury may be caused by physical conditions at the class location or by the negligence of THE SKY BARRE, its agents, employees, by me, or by other students.

*INTRO and SKY UNLIMITED MEMBERSHIPS: Unlimited Drop In Class Cards. Must cancel at least 6 hours prior to class or your card on file will be charged $15.Your membership will be frozen until fees are paid. LIMITED MEMBERSHIPS AND CLASS CARD HOLDERS: Class cards-failure to cancel my reservation within 6 hours prior to the class will result in that class being deducted from your account and considered "used" even though you were not present

*I hereby acknowledge and affirm that I have read the contents of this Agreement, I understand its terms, and I knowingly and voluntarily execute this agreement under my own free will, without relying on any statement or representation of THE SKY BARRE.

*I acknowledge that all class content, including but not limited to teaching method, curriculum, discussions, written materials, movements, dance steps, routines, choreography and scenery (hereinafter “Proprietary Information”) are the property of THE SKY BARRE, and constitute confidential and proprietary business information and trade secrets, the unauthorized disclosure of which will irreparably harm The Sky Barre. You further agree that in exchange for The Sky Barre agreeing to take you on as a student, you agree to keep any and all Proprietary Information confidential and that you will not disclose the Proprietary Information to anyone without the prior written consent of The Sky Barre. You further expressly agree that you will not use the Proprietary Information for the purpose of soliciting any students or employees of The Sky Barre or to otherwise compete with The Sky Barre

*I acknowledge that THE SKY BARRE has the sole discretion to remove, restrict, or bar from class any individual who appears intoxicated or otherwise disruptive to the conduct of a class, workshop or private party, and that any such removal will forfeit any deposits and payments made by that person for that session, workshop and/or private party.

*I acknowledge and affirm that I am not pregnant. If you are you must notify instructor immediately.

*I assume all responsibility and risk associated with any and all activity, program, course, or class that I participate in, and assume all responsibility and liability of physical fitness and capability to perform any and all activity or effort related to and/or associated with the class activities performed by me or which I am involved in. THE SKY BARRE is no way responsible for the safekeeping of your belongings during or after classes.

If a condition exists or develops which may prevent or restrict me from activities associated with THE SKY BARRE, I will obtain express permission and authorization from my medical provider to continue with such activities.

*I do not have any medical and/or physical condition that should, could, or will prevent me from participation in any and all activities associated with The Sky Barre

*I understand that all prices and services are subject to change at any time.

*I expressly affirm and acknowledge my understanding I shall be engaging in potentially dangerous physical activities, and that, although THE SKY BARRE will make all efforts to ensure that proper safety procedures are practiced, THE SKY BARRE cannot and will not be responsible for the actions and non-actions of its owners, agents, or employees (including, without limitation, its instructors), of me, or of other students.

*I hereby acknowledge and affirm that I have read the contents of this Agreement, I understand its terms, and I knowingly and voluntarily execute this agreement under my own free will, without relying on any statement or representation of THE SKY BARRE.

In consideration for your acceptance into the classes provided by THE SKY BAR and other good and valuable consideration paid, the receipt of which is hereby acknowledged, you hereby covenant and agree as follows:

I, including my heirs and assigns, will never institute, prosecute, or in any way aid in the institution or prosecution of any claim, suit, demand, action, or cause of action against THE SKY BARRE, its officers, directors, owners, partners, members, officers, heirs, assigns, agents, or employees for damages, expenses, costs, loss, injury either to person or property, or both, whether developed or undeveloped, foreseen or unforeseen, known or unknown, past, present or future, that may be sustained as a direct or indirect consequence of any course, class, or activity connected with, directed by, related to, or conducted by THE SKY BARRE. I further agree to indemnify, release, and hold harmless THE SKY BARRE, its officers, directors, owners, partners, members, officers, heirs, assigns, agents, and employees, from any and all claims, losses, illnesses, demands, and injuries to my person or property, foreseen or unforeseen, resulting from, caused by, or related to any class, program, or activity directed by, related to, or conducted by THE SKY BARRE. I agree to indemnify THE SKY BARRE with regard to any cost, expense (including reasonable attorneys’ fees and costs), and loss caused in any way by me. This Hold Harmless Agreement is not in derogation of, but rather supplements, any common law rights to indemnification to which THE SKY BARRE, its legal representatives, successors, and assigns may have. I acknowledge that this Hold Harmless Agreement is binding on and on my successors and assigns.

PARENT’S OR GUARDIAN’S ADDITIONAL INDEMNIFICATION (Must be completed for participants under the age of 18 only))

In consideration of the aforementioned minor participant (“Minor”) being permitted by Sky Barre to participate in its activities and to use its equipment and facilities, I further agree to indemnify and hold harmless Sky Barre from any and all claims which are brought by, or on behalf of Minor, and which are in any way connected with such use or participation by Minor.
